1. Account Setup & Email on File
Peak99 will set up your hosting account after payment has been received and after your order has passed fraud screening by us and/or our payment partners.
You must provide a valid email address that is not associated with the domain(s) you register or host with us. All important communication, including abuse reports or account notices, will be sent to this email. You are responsible for keeping this email address updated at all times.
If you register domain(s) through Peak99, you must ensure that the domain contact details are correct and up to date. Peak99 is not liable for expired domain registrations resulting from outdated contact information.
Providing false, inaccurate, or misleading contact information may lead to immediate account termination.
For dedicated servers or high-risk transactions, government-issued ID and/or a scan of the credit card used may be required. If these requirements are not met, the order may be declined as fraudulent.
Transfers
Our migration team will assist you in transferring your website to Peak99 as a courtesy service, but we do not guarantee:
- availability of the data,
- compatibility of your old hosting environment,
- or the time required for migration.
Some hosting platforms may use proprietary or incompatible formats that make migration partially or fully impossible.
Free migration services are available for 30 days from the date of signup. After that period, migration will be chargeable. Contact the billing team for a quote.
2. Content Policy
All services provided by Peak99 may only be used for lawful purposes under the laws of India and the State of Uttar Pradesh.
You agree to indemnify and hold Peak99 harmless from any claims resulting from illegal use of our services.
Copyright & Trademark Violations
- Hosting or distributing copyrighted or trademarked materials without permission is strictly prohibited.
- Selling counterfeit goods will result in immediate termination.
- Repeated copyright violations will lead to suspension and/or termination.

Prohibited Use – Shared & Reseller Hosting
Examples of unacceptable content or activities include (but are not limited to):
- Topsites
- IRC scripts/bots
- Proxy/anonymizer services
- Pirated/Warez content
- Image hosting scripts (e.g., Photobucket clones)
- AutoSurf/PTC/PTS/PPC sites
- Hacking tools, IP scanners, brute-force scripts
- Spam scripts, Mail Bombers
- Banner advertising networks
- File dump/mirror services
- High-Yield Investment Programs (HYIP)
- Ponzi/MLM schemes
- Controlled substances without permits
- Gambling/lottery sites
- Hate, harassment, racist content
- Hacker forums/tools
- Sites linking to illegal downloads
- Fraudulent services
- Mass mailing tools (Mailer Pro)
- Broadcasting or streaming live sporting events
Security & Monitoring
Peak99 systems may be monitored for security and authorized use. Any unauthorized access to third-party networks will result in suspension.
You must secure your scripts and files. Weak passwords may result in account suspension until fixed.
Adult content or pornography of any kind is not permitted.
Child exploitation content will result in immediate termination and reporting to law enforcement.
Prohibited Use – Dedicated Servers
(Everything above plus):
- IRC servers (IRCD)
- Torrent trackers or clients
Similar illegal/confidential network tools
3. Zero-Tolerance Spam Policy
Peak99 does not allow:
- Unsolicited emails
- Bulk email lists
- Purchased email lists
- Spamvertised websites
Any account sending spam will be terminated immediately, with or without notice.
Accounts may send maximum 200 emails per hour.
If your actions cause our IPs to be blacklisted, the account will be suspended and cleanup fees may be charged at Peak99’s discretion.
4. Payment Information
You agree to pay for Peak99 services in advance. Your services remain active and billable unless you request cancellation via the official cancellation form.
Unpaid invoices after a 10-day grace period will incur:
- 15% late fee
- potential account suspension
Domain renewal reminders are sent as a courtesy. You remain responsible for ensuring renewals are paid.
Refunds for duplicate PayPal payments will be added as account credit only.
Peak99 reserves the right to change pricing at any time.
5. Backups & Data Loss
Backups are performed once monthly, overwriting previous backups. Only one backup version is retained.
Backups are provided as a courtesy, and Peak99 is not responsible for loss of data.
You are fully responsible for maintaining your own backups.
No backups are provided for suspended or terminated accounts unless explicitly agreed to in writing.
6. Cancellations & Refunds
Peak99 may suspend or terminate accounts at any time, with or without notice, for violating policies.
Customers may cancel at any time using the cancellation link in the Billing Portal.
30-Day Money-Back Guarantee
Applies only to:
- Shared Hosting
- Reseller Hosting
The guarantee applies only to first-time customers.
Non-Refundable Items
- VPS plans
- Dedicated servers
- Domain purchases
- Admin fees, setup fees
- Custom software installation charges
Refund requests after 30 days (shared/reseller) will be prorated.
7a. Resource Usage Policy (Shared Hosting)
You may not:
- Use more than 25% CPU for longer than 30 seconds
- Run background/standalone server processes
- Run IRC-related software
- Host torrent applications
- Host game servers
- Run cron jobs < 15 minutes interval
- Run MySQL queries > 15 seconds
- Use shared hosting for backups/storage
8. Bandwidth Usage
Each hosting plan includes a monthly bandwidth limit.
If exceeded, Peak99 may:
- temporarily suspend access, or
- charge additional usage fees.
9a. Money-Back Guarantee (Non-Shared Services)
No refunds are provided for:
- Dedicated servers
- VPS services
- Domain registrations
- Dedicated servers
9b. Uptime Guarantee
If a shared/reseller server experiences physical downtime below 99.9% uptime, you may request one month of service credit, subject to approval.
9c. Customer Support
Peak99 provides full support for hosting services, email setup, and lifecycle assistance.
We do not provide coding, development, or third-party software support unless part of a managed service plan.
10. Reseller Responsibilities
Resellers must provide support to their own customers.
Peak99 does not support reseller clients directly.
Resellers are fully responsible for all activity within their accounts.
11. Shared Hosting / Dedicated Servers
Shared hosting users are not permitted to resell hosting services.
To resell hosting, you must upgrade to a Reseller Hosting Plan.
12. VPS & Cloud Servers
Peak99 may reset your VPS password to ensure security compliance.
If a VPS is compromised or used for abuse, we may suspend or reinstall the server
13. Fully Managed Hosting Services
This service includes elevated support for setup, optimization, security, and ongoing performance maintenance.
Managed services do not include custom development unless specified.
14. Price Changes
Peak99 may revise plan pricing or resource allocations at any time without prior notice.
15. Coupons
Coupons/discount codes apply only to first-time customers unless specified.
They cannot be used for domain purchases unless stated.
16a. Indemnification
You agree to indemnify and hold Peak99 harmless from any claims, losses, liabilities, or expenses arising from the use of our services.
16b. Arbitration
By using Peak99 services, you agree to resolve disputes through binding arbitration governed by the laws of India.
17. Disclaimer
Peak99 is not liable for:
- business losses
- data loss
- service interruptions
- security breaches
- or any consequential damages
Use of Peak99 services is at your own risk.
18. Disclosure to Law Enforcement
Peak99 may disclose user information to law enforcement upon receiving a lawful request. We may not notify the customer before disclosure.
19. Changes to Terms of Service
Peak99 reserves the right to modify these Terms at any time without prior notice.
